What influences compensation in a medical malpractice case?

On Behalf of Hofeld and Schaffner | Feb 27, 2023 | Medical Malpractice

Medical malpractice is an issue that affects many people across the world. According to the National Library of Medicine, about 3% of healthcare spending goes to medical malpractice-related costs each year.

In many cases, patients can get compensation for the suffering they have experienced due to a medical professional’s negligence. The process of determining the level of compensation involves a number of factors.

What is medical malpractice?

Medical malpractice is a form of professional negligence that occurs when a healthcare professional does not provide an acceptable standard of care and their actions (or lack thereof) cause harm or injury to a patient. Examples of medical malpractice can include misdiagnosis, failure to diagnose, surgical errors, prescription errors and birth injuries.

How can a patient get compensation?

One of the most important aspects of making a claim for medical malpractice is obtaining and evaluating medical evidence. A medical expert can review the patient’s medical records and determine if the healthcare provider’s actions constituted negligence and if so, what type of negligence occurred. This evidence will be essential in proving the claim in court.

In order to receive a larger settlement, the patient must be able to prove they have suffered a significant amount of harm. This may include providing evidence of the physical, emotional and financial impact the injury has had on their life. For example, the patient may provide documentation from their physician, proof of lost wages and other relevant evidence.

Medical malpractice claims can be complex and time-consuming, so patience is key. With the right mindset and support, a person can successfully navigate the process and receive the compensation they deserve.
